This privacy notice provides information about the processing of your personal data in connection with your use of our website (hereinafter referred to collectively as the “website”) and the functions made available through it.

II. Provision of the website and creation of server log files

 

1. Categories of data and description of data processing

 

The following data is processed each time our website is accessed:

 

  • IP address;
  • Date and time of access;
  • Time zone difference from Greenwich Mean Time (GMT);
  • Specific webpage accessed;
  • Access status/HTTP status code;
  • Amount of data transferred in each instance;
  • Website from which you arrived;
  • Browser;
  • Operating system and its interface;
  • Language and version of the browser software;
  • Internet service provider (collectively referred to as ‘server log files’).

 

2. Legal basis and purpose of data processing

 

The legal basis for the processing of your data in connection with your use of our website is Article 6(1)(e), (3) of the GDPR in conjunction with Section 10a of the IHKG, namely the public tasks entrusted to us, in particular the representation of the overall interests of affiliated businesses in the Federal Republic of Germany at national, European and international level, the promotion of the commercial economy, and the coordination and promotion of the AHK network, including delegate offices and representative offices, as well as the promotion of the Federal Republic of Germany’s foreign trade. To further this purpose, a fully functional website is provided and the associated processing of personal data takes place.

 

3. Duration of storage

 

Server log files are deleted after seven days at the latest.

 

In the event of an error, logs are also generated; these are then stored for a period of 30 days for error analysis and problem tracing, after which they are deleted.

 

4. Recipients

 

Access to server log files is granted to those employees of the data controller who are responsible for managing the website. In this context, employees of DIHK DEinternational GmbH may have access to your personal data. For this reason, the AHK, DIHK and DIHK DEinternational GmbH have entered into a data protection group agreement governing the processing and transfer of personal data within the AHK network.

 

We also use third-party services on our website. Further information on these services and the associated data processing can be found under [Part B] [SPB1] and in the cookie settings.

 

III. Website Analysis with Piwik PRO Analytics Suite

 

1. Data Categories and Description of Data Processing

 

We use Piwik PRO Analytics Suite as our website analytics software. We collect data about website visitors in the form of server log files and on the basis of cookies. 2. Legal basis and purpose of data processing

 

The purpose of using the PIWIK PRO Analytics Suite is to track certain metrics, such as bounce rate, page views and session duration, in order to understand how our website is used. We may also create visitor profiles based on browsing history to analyse visitor behaviour, display personalised content and run online campaigns. The legal basis for analytics and conversion tracking is your consent pursuant to Article 6(1)(a) of the GDPR.

 

3. Duration of storage

 

If you give us your consent for analytics and conversion tracking, we will store your personal data for a period of 25 months and delete it thereafter, unless you have withdrawn your consent in this regard; in this case, we will no longer store any personal data from the time we receive your withdrawal. Your withdrawal of consent only takes effect for the future and has no impact on the processing of your data prior to your withdrawal.

 

4. Recipients

 

The recipients of your personal data are employees of DIHK DEinternational GmbH and the AHK who are responsible for managing the website. In addition, there may be instances (e.g. in the event of troubleshooting) where employees of PIWIK PRO Analytics Suite, the AHK and DIHK DEinternational GmbH may have access to your personal data. As part of its service provision, PIWIK PRO Analytics Suite uses third-party providers, some of whom are based in the USA, so it is possible that your personal data may be transferred to these third-party providers. VI. Use of Cookies

 

1. Categories of data and description of data processing

 

We use Piwik PRO to manage consent and, for this purpose, collect personal data via cookies. We also use cookies to make our website more user-friendly. Cookies are small text files that are stored on your computer. Some of the cookies we use are deleted from your hard drive once your browser session ends. In addition, we also set persistent cookies that remain on your device, for example to recognise you the next time you visit our website.

2. Legal basis and purpose of data processing

 

The legal basis for the management of consent by PIWIK PRO is our legitimate interest, pursuant to Article 6(1)(f) of the GDPR, in ensuring that consent management is compliant with the law and tailored to specific usage.

 

If personal data is also processed by individual cookies set by us, the processing takes place on the following legal bases, depending on the cookie set:

 

  • Necessary cookies: The processing of personal data by necessary cookies is based on our legitimate interests pursuant to Article 6(1)(f) of the GDPR, as these cookies are necessary for the proper functioning of the website. The setting of the cookie is also based on Section 25(2)(2) of the TDDDG, according to which the storage of information on your device or access to information already stored on your device is strictly necessary so that we can provide a digital service – our website – that you have expressly requested.
  • All other cookies: The setting of these cookies in accordance with Section 25(1) of the TDDDG and the processing of personal data are based on your consent pursuant to Article 6(1)(a) of the GDPR. These cookies collect information about your use of our website, which we use to improve functionality and your user experience.

Data relating to the management of consent is stored for a period of 25 months.

4. Recipients

 

Access to your personal data is granted to those employees of the controller who are responsible for maintaining the website. In addition, there may be instances (e.g. in troubleshooting cases) where employees of PIWIK PRO may gain access to your personal data. Where PIWIK PRO employees have access to personal data, we have entered into the necessary agreements to protect your personal data, in particular data processing agreements in accordance with Article 28 of the GDPR, in which PIWIK PRO is bound by a duty of confidentiality.

 

VII. Map Service

 

i. Data categories and description of data processing

 

We have integrated the “OpenStreetMap” (“OSM”) map service into our website. This is a service provided by the OpenStreetMap Foundation, with its registered office at St John’s Innovation Centre, Cowley Road, Cambridge, CB4 0WS, United Kingdom, which is the controller for OSM within the meaning of Article 4(7) of the GDPR.

 

The map display is only shown once you have given your consent.  

 

In order to display OSM, server log files are transmitted to the OpenStreetMap Foundation. For information on how your personal data is processed by the OpenStreetMap Foundation, please refer to the OpenStreetMap Foundation’s privacy policy at https://osmfoundation.org/wiki/Privacy_Policy .

 

ii. Legal basis and purpose of data processing

 

The legal basis for the processing of your personal data is your consent pursuant to Article 6(1)(a) of the GDPR. The processing of your personal data serves to display a map for the purpose of location display and route planning.

iv. Recipients

 

The OpenStreetMap Foundation is the recipient of your personal data.

 

VIII. Automated Decision-Making and Profiling

 

With the exception of the processing described in Section V, we will not process your personal data for the purposes of automated decision-making and/or profiling.

 

IX. Obligation to Provide Personal Data

 

You may choose not to provide us with your personal data, or to provide incomplete data. In such cases, for example if you prevent the storage of a cookie, this may mean that you are unable to use all the features of our website. If you wish to become a member but do not provide us with your personal data, we may be unable to process your membership application.

 

X. Rights of the data subject

 

You may contact ProRecognition directly, either in writing or by email [ruhl.mareike@dihk.de], to exercise the following rights:

 

Access to your data in order to check and verify it,

 

  • Receipt of a copy of your personal data,
  • Rectification, erasure or restriction of processing; this also includes the right to have incomplete or incorrect data completed by providing additional information,
  • Right to object to processing; please note that, pursuant to Article 21 of the GDPR, you have the right to object to the processing of personal data that we process on the basis of legitimate interests in accordance with Article 6(1)(f) of the GDPR; a right to object to processing exists insofar as this is based on grounds arising from your particular situation; insofar as the objection relates to the processing of personal data for the purposes of direct marketing, you have a general right to object without the need to specify a particular situation,
  • You may receive the data you have provided in a structured, commonly used and machine-readable format and transmit this data to another controller, provided that you have given your consent to the processing or the processing is based on a contract.

 

If you have given us your consent to process your personal data, you may withdraw this consent at any time with effect for the future.

 

You also have the right to lodge a complaint with a supervisory authority regarding the processing of your personal data.

 

Contact form and email contact

 

i. Data categories and description of data processing

 

If you use the contact form embedded on our website to contact us, we will process

 

  • your full name,
  • your company,
  • your email address and
  • a message. The data mentioned are marked as mandatory fields.

 

We also process server log files (see IV.1) in addition to your personal data described here the moment you access our contact form.

 

As an alternative to our contact form, you may contact us via the email address provided.

 

In this case, the user’s personal data transmitted via the email will be processed.

 

ii. Legal basis and purpose of data processing

 

The legal basis for processing your data marked as mandatory fields is, in accordance with Article 6(1)(b) of the GDPR, the enquiry you have submitted to us. The same applies to any contact you make with us via email.

 

The legal basis for data that is not marked as a mandatory field and which you provide to us voluntarily is your consent pursuant to Article 6(1)(a) of the GDPR. With regard to the data you provide to us voluntarily, you may withdraw your consent at any time. You may withdraw your consent by emailing ruhl.mareike@dihk.de. We will retain your data until we receive such a withdrawal.

 

We process your personal data in order to process and respond to your enquiry.

 

iii. Duration of storage

 

Your personal data will be deleted as soon as your enquiry has been fully answered. If you have given us your consent, we will process your data until you withdraw your consent or your enquiry has been fully answered.

 

iv. Recipients

 

Access to your personal data is granted to those AHK staff members who are responsible for responding to enquiries. In addition, staff members of DIHK DEinternational GmbH and/or other AHKs may also be granted access to your personal data. To this end, we have concluded an intra-group data transfer and processing agreement with the AHK network, which incorporates the EU Standard Contractual Clauses. Social media button

 

On our website, you will find a social media button for LinkedIn.

 

The operator of the social media button is LinkedIn Ireland Unlimited Company (hereinafter referred to as “LinkedIn”), Wilton Place, Dublin 2, Ireland. When you click the social media button, your browser connects to LinkedIn’s servers. In doing so, your personal data is transmitted to LinkedIn. If you are logged into your LinkedIn account whilst visiting our website, LinkedIn may associate this information with your personal LinkedIn account.  Information regarding the processing of your personal data by LinkedIn can be found in LinkedIn’s privacy policy at www.linkedin.com/legal/privacy-policy. The legal basis for your use of the social media button is your consent in accordance with Article 6(1)(a) of the GDPR.
